Constanta, postal code 907280, Romania, registered at the Trade Register under no. J13/1132/13.04.2006, Tax ID RO18585579, operates the platforms www.cramadarie.ro and shop.cramadarie.ro (hereinafter referred to as the Website).

By accessing and using the Website, you confirm that you have read, understood and fully accepted these Terms and Conditions. If you do not agree with any of the provisions below, please do not use the Website.

1. Definitions

For the purposes of this document, the terms below have the following meanings:

  • Seller - Vinum Capidava S.R.L. (Crama Darie), operator of the Website.
  • Buyer - a natural person over 18 years of age or a legal entity placing an Order through the Website.
  • User - any person who accesses and browses the Website.
  • Order - the electronic document by which the Buyer communicates to the Seller their intention to purchase Products through the Website.
  • Contract - the distance contract concluded between the Seller and the Buyer, without their simultaneous physical presence, through the Sellers acceptance of the Order.
  • Product - any good, including alcoholic beverages, and any other product or service sold through our platforms.
  • Account - the section of the Website accessible by authentication with an email address and password, containing the Buyers information and Order history.
  • Website - the domain www.cramadarie.ro, shop.cramadarie.ro and associated subdomains.

2. General Terms of Use

Access to and use of the Website is permitted exclusively to persons aged 18 or over. By using the Website, you declare on your own responsibility that you are of legal age for the consumption and purchase of alcoholic beverages, in accordance with Romanian legislation in force (Law no. 61/1991).

Use of the Website implies full acceptance of these conditions. We reserve the right to modify these Terms and Conditions at any time without prior notice. Continued use of the Website after publication of changes constitutes acceptance thereof.

To place an Order, creating an Account may be required. You are responsible for maintaining the confidentiality of your authentication data and for all activities carried out through your Account.

3. Products and Prices

All products displayed on the Website are available subject to existing stock. Product descriptions, photographs and specifications are for informational purposes and may contain minor differences from the physical product, without affecting its quality or essential properties.

All prices displayed on the Website are expressed in Romanian Lei (RON) and include value added tax (VAT) in accordance with applicable legislation. We reserve the right to change prices without prior notice; previously confirmed orders remain at the price at the time of confirmation.

In the event that a price displayed on the Website is obviously erroneous (material error), we reserve the right to cancel the order and notify you as soon as possible.

4. Orders and Payments

Placing an Order on the Website constitutes an offer from the Buyer. The Contract is considered concluded only when the Seller confirms acceptance of the Order by confirmation email.

We reserve the right to refuse, limit or cancel any Order for justified reasons, including but not limited to: product unavailability, pricing errors, suspicion of fraud or failure to meet the minimum age requirement.

Payment is made through the payment methods available on the Website at the time of placing the Order. Payment information is processed securely through authorised payment service providers.

The tax invoice will be issued and transmitted electronically to the email address provided by the Buyer, in accordance with applicable tax legislation.

5. Delivery

Product delivery is carried out on the territory of Romania through authorised courier services, under the conditions provided in the Shipping Policy.

Estimated delivery time, transport costs and specific conditions are detailed in the Shipping Policy and may vary depending on the geographical area, product availability and logistics partner capacity.

Delivery of alcoholic products is made exclusively to persons aged 18 or over. The courier has the right to request an identity document to verify the recipients age.

6. Right of Withdrawal

In accordance with the provisions of Emergency Ordinance no. 34/2014, you have the right to withdraw from the Contract within 14 calendar days from the date on which you took physical possession of the products, without having to justify your decision.

The conditions for exercising the right of withdrawal, the return procedure and refund conditions are detailed in the Cancellation and Return Policy.

In accordance with Art. 16 of EO 34/2014, the right of withdrawal does not apply to sealed goods which cannot be returned for health protection or hygiene reasons and which have been unsealed by the consumer after delivery. This includes opened wine bottles or bottles with damaged seals.

7. Guarantees and Complaints

All products sold benefit from the legal guarantee of conformity, under the conditions provided by the Civil Code and applicable consumer protection legislation.

The Seller is liable for any lack of conformity existing at the time of product delivery. If you find quality or conformity defects, please contact us as soon as possible with a detailed description of the problem and relevant photographs.

Complaints will be analysed and resolved in accordance with applicable legislation. We undertake to respond within a reasonable time from receipt of the complaint.

8. Intellectual Property

All content on the Website, including but not limited to texts, images, graphics, logos, registered trademarks, trade names, design elements, databases, software and any other content, is the exclusive property of Vinum Capidava S.R.L. or its licensors and is protected by Romanian and international copyright and intellectual property law.

Reproduction, distribution, modification or use for any commercial purpose of the Website content without the prior written consent of the Seller is prohibited.

9. Limitation of Liability

The Website is provided as is and as available. We do not guarantee that the Website will function uninterrupted, without errors or in a secure manner at all times.

To the maximum extent permitted by applicable law, the Seller shall not be liable for:

  • Indirect, incidental or consequential damages resulting from the use or inability to use the Website.
  • Loss of data, profits or business opportunities.
  • Content or practices of third-party websites accessed through links on the Website.
  • Temporary service interruptions due to maintenance, updates or external factors.

10. Force Majeure

Neither party shall be liable for non-performance or delayed performance of its contractual obligations if such failure is due to force majeure or fortuitous event, as defined by the Civil Code.

The affected party shall notify the other party of the occurrence of the force majeure event as soon as possible. If the force majeure event continues for more than 30 days, either party may terminate the Contract without the obligation to pay damages.

11. Applicable Law

These Conditions are governed by Romanian law. Any dispute arising from or in connection with these Terms and Conditions shall be subject to the jurisdiction of the courts at the Sellers registered office, except where consumer protection legislation provides for different jurisdiction.

By subscribing to the newsletter, you consent to receiving commercial communications at the email address provided. You may withdraw your consent at any time through the unsubscribe mechanism available in each email or by contacting us at the email address indicated below.

The processing of personal data for commercial communications is carried out in accordance with the Privacy Policy.

14. Final Provisions

If any provision of these Conditions is declared null or unenforceable, this shall not affect the validity of the remaining provisions, which shall continue to produce effects.

The Seller reserves the right to assign the rights and obligations arising from these Terms and Conditions to any third party, without prior notification to the Buyer.

These Conditions, together with the Privacy Policy, Cookie Policy, Shipping Policy, Cancellation and Return Policy and GDPR Policy, constitute the entire agreement between the Seller and the Buyer regarding the use of the Website and the purchase of Products.
