Cancellation and Return Policy

In accordance with Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, transposing Directive 2011/83/EU of the European Parliament, you have the right to withdraw from the sales contract within 14 days of receiving the products, without having to justify your decision.

1. Legal Framework

This policy has been drawn up in accordance with Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as with applicable Romanian and European consumer protection legislation.

2. Right of Withdrawal

You have the right to withdraw from the contract within 14 calendar days from the date on which you took physical possession of the products, without having to justify your withdrawal decision.

To exercise your right of withdrawal, you must inform us through an unambiguous statement (by email or telephone) about your decision to withdraw from the contract. We will confirm receipt of the request as soon as possible and will communicate the next steps.

3. Eligible Products

The right of withdrawal applies to products that are in their original condition, unsealed and unconsumed. Bottles must be intact, with the label and seal untouched.

In accordance with Art. 16 of EO 34/2014, the right of withdrawal does not apply to sealed goods which cannot be returned for health protection or hygiene reasons and which have been unsealed by the consumer after delivery. This includes opened wine bottles or bottles with damaged seals.

4. Return Procedure

To initiate a return, please follow the steps below:

  1. Contact us by email at Office@CramaDarie.Ro or by phone at +40 723 046 002, indicating the order number and the products you wish to return.
  2. We will confirm receipt of your request and will communicate the return address and necessary instructions.
  3. Ship the products in their original packaging, in perfect condition, to the communicated address.

5. Return Conditions

Products must be returned in their original packaging, in perfect condition, unsealed and unconsumed. You are responsible for any diminished value of the products resulting from handling beyond what is necessary to establish the nature and characteristics of the products.

The deadline for returning the products is 14 days from the date of communicating the withdrawal decision.

6. Return Costs

The direct costs of returning the products are borne by the buyer, except in cases provided by applicable legislation (incorrectly delivered products or products with quality defects).

7. Order Cancellation

You can cancel an order free of charge before dispatch. After dispatch, the standard return procedure applies. For cancellation, contact us as soon as possible at Office@CramaDarie.Ro.

8. Refund Process

The refund is made within the timeframe provided by applicable legislation, from the date of receipt of the returned products or from the date on which you provide proof of dispatch, whichever comes first.

The refund will be made using the same payment method used for the original transaction, unless you expressly agree to a different refund method, at no additional cost to you.

We reserve the right to delay the refund until receipt of the returned products or until receipt of proof of their dispatch.

9. Special Situations

In the case of products damaged during transport, please contact us within 48 hours of receipt, with photographs of the products and packaging. We will analyse the case and provide an appropriate solution in accordance with applicable legislation.

In the event that you receive a product different from the one ordered, the return and re-delivery costs will be borne entirely by the Seller.

10. Legal Guarantee vs. Right of Withdrawal

The right of withdrawal (14 days) is different from the legal guarantee of conformity. The legal guarantee covers conformity defects of the product and is exercised under the conditions provided by the Civil Code, independently of the right of withdrawal.
